NOTICE OF SALE OF REAL PROPERTY

Notice is hereby given by the City of Nappanee Redevelopment Commission (hereinafter “Commission”) that on January 27, 2026 at 7:00 a.m. local time (EDT), the Commission will meet at the Nappanee City Hall, 300 West Lincoln Street, Nappanee, Indiana 46550 to open and consider written offers for the purchase and development of certain real property within the City of Nappanee commonly known as 107 Market Street, Nappanee, Indiana and as further described as follows (hereinafter “Real Property”):

Tract 1:

The South One-third of Lot Number 24 in the Original Plat of the Town, now City of Nappanee, Indiana; said Plat being recorded in Deed Record 48, page 280, in the Office of the Recorder of Elkhart County, Indiana.

Being tax code number: 20-14-31-301-004.000-029.

Tract 2:

Forty-four feet of and from the North end of Lot Number 24 in John Culp, Jr.’s Division of the Original Plat of the Town, now City of Nappanee, Elkhart County, Indiana; said Plat being recorded in Deed Record 48, page 280, in the Office of the Recorder of Elkhart County, Indiana.

Being tax code numbers: 20-14-31-301-001.000-029, 20-14-31-301-002.000-029, and 20-14-31-301-003.000-029.

NOTE: For the purposes of this request, no survey of the described real estate was done, and no monuments were set. Legal descriptions here are from public records for the subject real estate.

The Commission is willing to entertain proposals for the purchase of the Real Property for the purposes described in this notice. The offer should meet the conditions set forth below. 

PROPERTY DESCRIPTION AND SALE INFORMATION

The Real Property generally consists of a 0.199-acre area, located at 107 Market Street, in downtown Nappanee located at the corner of East Market Street and South Main Street. The Real Property is currently zoned B-2 General Business.

The minimum offering price for the purchase of the Real Property is $446,000. Only offers for the entirety of the Real Property will be considered. Real Property will be sold “AS IS”.

OFFERING PACKET AND BID DEADLINE

A detailed Offering Packet including this Notice of Sale of Real Property and any maps or plats showing the size and location of the Real Property are available for inspection at the Nappanee City Hall Planning Department, 215 West Market Street, Nappanee, Indiana. Submissions should provide a detailed written description of the intended use of the Real Property; the anticipated timeframe(s) for the proposed use or development; the estimated dollar amount of personal property and/or real property improvements; and other information requested in the Offering Packet.

All offers must be filed with Todd Nunemaker, City Planner, City of Nappanee no later than 12:00 p.m. local time (EDT) on January 23, 2026, at the Nappanee City Hall, 300 West Lincoln Street, Nappanee, IN, and shall be in the form described in the Offering Packet. Late proposals will be returned unopened. 

IMPORTANT DATES

  • October 28, 2025 7:00am — Issuance of Offering Packet
  • November 12, 2025 10:00am — Pre-bid meeting at City Hall
  • December 12, 2025 12:00pm — Deadline for question from Bidders
  • January 23, 2026 7:00am — Submission deadline for Proposals
  • January 27, 2026 7:00am — Proposals/Bids opened at public meeting
  • February 10, 2026 7:00am — Anticipated Award Date

DEVELOPMENT STANDARDS AND LIMITATIONS

  1. The Real Property must be maintained in full compliance with local City codes and ordinances immediately after acquisition.
  2. Real Property must be developed and utilized in accordance with the description in the Offering Packet.
  3. The property may not be sold to a person who is ineligible under Indiana Code § 36-1-11-16.
  4. A bid submitted by a trust (as defined in Indiana Code § 30-4-1-1(a)) must identify each beneficiary of the trust and each settlor empowered to revoke or modify the trust.
  5. A successful bidder will be required to enter into a Development Agreement with the Commission with respect to these development standards, standards detailed in the Offering Packet, and other matters. 

SELECTION CRITERIA

The Commission reserves the right to reject any or all offers. Offers may consist of consideration in the form of cash, other property, or a combination of cash and other property. With respect to property other than cash, the offer must be accompanied by evidence of the property’s fair market value. In determining the best offer, the Commission will take into account price; the timing of the transaction and development of the Real Property; developer’s qualifications and experience; the proposed development plan and future uses; the scope of investigation and communication with parties related to the approval process; how the offer and intended use(s) contribute to the City’s plans for development; and other criteria detailed in the Offering Packet and/or permitted by Indiana Code § 36-7-14-22.

This notice is given pursuant to Indiana Code § 36-7-14-22(d) and Indiana Code § 5-3-1-2(e).
